Terms & Conditions

These Terms and Conditions (“Terms”) govern the supply of services by
Diverse Dogs Pty Ltd (ABN 29 656 858 990), trading as “Diverse
Dogs” (“Diverse Dogs”, “we”, “us”, “our”), to you, the client
(“you”, “your”). By booking, paying for, taking part in or otherwise
using any of our services or activities — whether or not you have signed
a Client Agreement & Waiver — you agree to these Terms and
Conditions and to the relevant Client Agreement & Waiver for that
service. Please read them carefully and keep a copy.
Diverse Dogs Pty Ltd is based in Queensland, Australia. These
Terms should be read together with our Refund & Cancellation Policy
and the Client Agreement & Waiver for each service.
1. About us and these Terms
Diverse Dogs provides dog training, dog-care and related wellbeing
services across Brisbane, the Gold Coast, Tweed and online. We also
travel to other areas of Australia from time to time and deliver
services online Australia-wide. These Terms apply to all of our
services, together with any service-specific terms in the Schedules at
the end of this document, the separate Client Agreement & Waiver for
each service, and our Refund & Cancellation Policy. Together these
form the agreement between us. If there is any inconsistency, the signed
Client Agreement & Waiver and the relevant Schedule prevail for that
service.
We may update these Terms from time to time. The version in force
when you book applies to that booking. The current version is available
on request and at www.diversedogs.com.au.
2. Our services
These Terms cover the following services:

Private Training Lessons — one-to-one dog
training sessions in which you handle and work with your dog, and in
which our trainer may also handle and work with your dog as part of the
training (see Schedule A). -
The Day Out — a day service in which we collect
and/or take your dog into our care to train, exercise and/or socialise
it, and return it to you. The owner does not attend (see Schedule
B). -
Dog Trainer Certification — an education and
certification program for people developing dog-training skills or
credentials (see Schedule C). -
Breaths & Barks Retreats — a multi-day
residential retreat combining dog-handling activities, breathwork,
mindfulness and related wellbeing exercises (see Schedule D). -
Board & Train — a program in which your dog
stays in our care for an agreed period so we can train it intensively on
your behalf, before returning it to you with handover guidance. The
owner does not attend (see Schedule E).
3. Bookings and acceptance
A booking is confirmed only once we have accepted it and any required
deposit or payment has been received. We may decline or cancel a booking
at our discretion, including where we consider a service is not suitable
or safe for a particular dog, handler or participant.
You accept these Terms by booking, paying for or taking part in any
of our services or activities, whether or not you have signed a Client
Agreement & Waiver. You must be at least 18 years of age to book or
participate. If you book for another person or organisation, you confirm
you are authorised to accept these Terms on their behalf.
4. Fees and payment
Fees are as quoted at the time of booking or in our current price
list. Unless stated otherwise, fees are in Australian dollars and
include GST where applicable.
We may accept payment through third-party “buy now, pay
later” providers and other methods we make available. Where you
pay using a buy now, pay later provider, your finance arrangement is a
separate agreement between you and that provider, subject to the
provider’s own terms, eligibility criteria and fees. Diverse Dogs is not
a party to, and is not responsible for, that arrangement. You remain
responsible to us for the full price of the service unless and until it
is paid.

Full payment or a deposit may be required before a service is
provided or a place is reserved. -
Deposits secure your booking and, except as required by the
Australian Consumer Law or as stated in our Refund & Cancellation
Policy, are applied to cancellation, planning and administration
costs. -
Where a payment fails, is reversed or is charged back, we may
suspend or withhold services until the amount owing is paid.
5. Your responsibilities
To keep everyone safe and give the service the best chance of
success, you agree that:

You are the legal owner of the dog, or are fully authorised by
the owner to enrol the dog. -
Health and vaccination: your dog is in good
health, appropriately vaccinated for its age, and treated for fleas,
ticks and worming. You will not present an unwell, contagious or
infectious dog. -
Honest disclosure: before the service begins you
will tell us about any history of aggression, biting, fear, resource
guarding, medical conditions, injuries or other behaviour we should
reasonably know about. This is essential for safety. -
You will provide accurate information and follow the reasonable
instructions, training plans and safety directions we give. -
You will keep your dog under control except while it is in our
care, and you are responsible for ensuring your dog wears appropriate,
well-fitted equipment — including a collar that is in good condition and
fitted so that your dog cannot slip out of it. -
You are responsible for supplying any food or treats to be used
in training. If you do not supply them and Diverse Dogs provides food or
treats for a session, an additional fee may apply. -
You hold current council registration for your dog and comply
with all laws relating to dog ownership.
6. How we provide our services
We will provide our services with due care and skill, using methods
we consider appropriate and humane, and within a reasonable time. Our
training is ethical and science-backed in how we communicate with and
teach dogs. While we prioritise reward-based training, in certain
circumstances we may recommend alternative, balanced methods suited to
the individual dog. The nature, order and pace of a service may be
adjusted to suit the dog, handler or participants.
7. Training and wellbeing outcomes are not
guaranteed
Dogs are living animals and their behaviour is influenced by many
factors outside our control, including genetics, health, environment,
age, prior experiences and the consistency of handling and practice
between sessions. Similarly, wellbeing activities affect people
differently. Except for the guarantees we cannot exclude under the
Australian Consumer Law, we do not and cannot guarantee any particular
result, timeframe, behavioural change, or that a dog or participant will
pass any assessment. Your commitment between sessions significantly
affects outcomes.
8. Assumption of risk and physical activity
You acknowledge that handling, moving with, training, exercising and
socialising a dog is a physical activity that carries inherent risks —
including being bitten, scratched, pulled, knocked over, tripped or
otherwise injured — and that some of our services also involve physical
exertion, movement and outdoor activity. You take part voluntarily and,
to the extent permitted by law, accept those inherent risks.
Before commencing each service you must complete and sign the
relevant Client Agreement & Waiver, which sets out
the service-specific terms, health and behaviour disclosures, and
assumption of risk. We may decline to provide a service until it is
signed.
Recreational services: some activities (including our Breaths
& Barks Retreats) are “recreational services” under the Australian
Consumer Law. Where they are, the relevant Client Agreement & Waiver
may lawfully exclude certain liability for death or personal injury
under section 139A of the Competition and Consumer Act 2010 (Cth).
Nothing in the waiver limits rights that cannot be excluded under the
Australian Consumer Law.
9. Health, safety and veterinary care
While your dog is in our care we will take reasonable care of its
safety and welfare. Dog training, handling, exercise and socialisation
carry inherent risks, including injury, illness, escape or, in rare
cases, death, which can occur despite reasonable care.
Whenever your dog is in our care without you present, you are
responsible for being contactable in case of emergency and for keeping
your contact and emergency details up to date — please tell us straight
away if your phone number or details change. If your dog becomes unwell
or injured, our trainers will give all due care and get your dog to a
vet as quickly as possible. However, many vets will only accept medical
decisions from the registered owner, so you acknowledge that making any
important medical decisions is your responsibility and that we cannot be
expected to make them on your behalf. All veterinary treatment, expenses
and bills are your responsibility.
10. Liability
Nothing in these Terms excludes, restricts or modifies any guarantee,
right or remedy you have under the Australian Consumer Law
(ACL) or any other law that cannot lawfully be excluded. Our
services come with guarantees that cannot be excluded under the ACL.
To the maximum extent permitted by law, and except for those
non-excludable guarantees:

our liability for a failure to comply with a consumer guarantee
(other than a guarantee as to title) is limited, at our option, to
resupplying the service or paying the cost of having it
resupplied; -
we are not liable for any indirect, special or consequential
loss; and -
we are not liable for loss or damage caused by your failure to
disclose relevant information, your failure to follow our instructions,
or matters outside our reasonable control.
You are responsible for the behaviour of your dog at all times except
while it is directly in our care, including any injury or damage your
dog causes to people, animals or property.
11. Cancellations, rescheduling and refunds
Cancellations, rescheduling, no-shows and refunds are governed by our
Refund & Cancellation Policy, which forms part of
these Terms and includes rules specific to each service. Your rights
under the ACL always apply in addition to that policy.
12. Privacy
We collect personal information (such as your contact details and
information about your dog) to provide our services, and handle it in
accordance with the Privacy Act 1988 (Cth) and our Privacy Policy. We do
not sell your personal information. Payment information you provide to a
third-party payment or buy now, pay later provider is handled by that
provider under its own privacy policy.
13. Intellectual property
All training and course materials, manuals, handouts, videos and
assessment materials we provide (including for Dog Trainer Certification
and the retreats) remain our intellectual property or that of our
licensors, and are provided for your personal use only. You must not
copy, resell, redistribute, publish or commercially reuse them without
our written permission.
14. Media
We take photos and video during our services and use this content for
marketing and social media. By booking, taking part in or otherwise
using our services, you consent to us taking and using photos and video
that include you and/or your dog for these purposes. This consent
applies whether or not you have signed a Client Agreement &
Waiver.
15. Force majeure
We are not responsible for failing to provide a service where
prevented by events beyond our reasonable control (such as extreme
weather, natural disaster, illness, injury or government restrictions).
In those cases we will offer to reschedule or, where a service cannot be
provided, act in accordance with our Refund & Cancellation Policy
and the ACL.
16. Governing law
These Terms are governed by the laws of Queensland, Australia, and
you and we submit to the non-exclusive jurisdiction of its courts. If
any provision is unenforceable, the remaining provisions continue to
apply.

Schedule A — Private Training Lessons

Sessions run for approximately 60 minutes and are delivered in
person at an agreed location, at your home, or online as agreed at
booking. -
You (or a responsible adult you nominate) should normally attend
and take part, as owner involvement is important to private lessons. In
some sessions our trainer may also handle and work with your dog as part
of the training. Handling a dog is a physical activity — see clause 8
and your signed Waiver. -
You are responsible for supplying any food or treats to be used
in your dog’s training. If you do not supply them and Diverse Dogs
provides food or treats for the session, an additional fee may
apply. -
Rescheduling is subject to the notice rules in our Refund &
Cancellation Policy. -
Lesson packages must be used within 6 months of purchase unless
we agree otherwise.
Schedule B — The Day Out

The owner does not attend. We collect and/or
receive your dog, provide training, exercise and/or socialisation for
the agreed period, and return your dog at the agreed time and
place. -
You must give us an accurate health and behaviour history,
confirm vaccinations are current, and complete the Day Out Client
Agreement & Waiver, including the emergency-contact and veterinary
acknowledgements. -
You are responsible for supplying any food or treats to be used
in your dog’s training during the day. If you do not supply them and
Diverse Dogs provides food or treats, an additional fee may
apply. -
You are responsible for ensuring your dog wears appropriate,
well-fitted equipment — including a collar in good condition that your
dog cannot slip out of — and you must remain contactable in case of
emergency while your dog is in our care. -
We may decline or end a Day Out if a dog is unwell, unvaccinated,
or presents a safety risk to itself, other dogs, people or
staff. -
Collection and drop-off times are estimates and may vary with
traffic, weather or the needs of the dogs in our care. -
Same-day cancellations and no-shows are treated in accordance
with our Refund & Cancellation Policy.
Schedule C — Dog Trainer Certification

The program is delivered fully online and is self-paced. It
includes 17 modules and 80+ video lessons (with new content added over
time), live online coaching with Tim and the team, and a genuine
assessment process — including theory exams and supervised work with
real dogs and client volunteers — designed to prove real
competence. -
The program also includes up to 50 hours of real shadow
experience (with Diverse Dogs or our team if you are local, or with any
experienced trainer of your choice by agreement). Travel is
optional. -
Nature of certification: the Diverse Dogs
certification is a Diverse Dogs Certificate of Completion and is not a
nationally accredited qualification. Graduates qualify for insurance
with Marsh Pet Professional Insurance and Pet Business International
Insurance, so the course is a recognised pathway into the industry — you
can get insured to work with clients while you learn and begin working
once you certify. -
Enrolment reserves your place and access to course materials,
which are licensed to you for personal study only and must not be shared
or resold. -
Certification is awarded on successful completion of all required
components and assessments. Enrolment does not guarantee
certification. -
Withdrawals, transfers and refunds (including the 7-day risk-free
period) are governed by our Refund & Cancellation Policy.
Schedule D — Breaths & Barks Retreats

Format: a multi-day residential retreat
(currently 4 days). The venue, itinerary, activities, inclusions and
costs are advertised for each individual retreat and may vary from one
retreat to the next. Accommodation and meals are included. -
Activities: may include dog-handling, guided
walks, scent work and searching activities, breathwork, mindfulness and
related wellbeing exercises. These are physical, recreational activities
— see clause 8 and the retreat Waiver. -
Participation: participants must be 18 or over,
be reasonably fit to take part, and disclose relevant medical
conditions. The retreat is for participants to bring their own
dog. -
Fees and payment terms are advertised with each retreat, as they
may depend on the circumstances of that retreat. Cancellations,
transfers and refunds are governed by our Refund & Cancellation
Policy. -
You must follow venue rules and staff safety directions, and are
responsible for any damage you or your dog cause.
Schedule E — Board & Train

The owner does not attend. Your dog stays in our
care (boards with us) for an agreed period so we can train it
intensively on your behalf, and we return your dog to you with handover
guidance at the end of the program. -
The program length, what is included, and the fee are advertised
or quoted for each program and may vary depending on your dog’s needs
and goals. -
You must give us an accurate health and behaviour history,
confirm vaccinations are current, and complete the Board & Train
Client Agreement & Waiver, including the emergency-contact and
veterinary acknowledgements. -
You are responsible for supplying your dog’s usual food for the
duration of the program, along with any specific treats. If you do not
supply them and Diverse Dogs provides food or treats, an additional fee
may apply. -
You are responsible for ensuring your dog wears appropriate,
well-fitted equipment — including a collar in good condition that your
dog cannot slip out of — and you must remain contactable in case of
emergency while your dog is in our care. -
Training outcomes are not guaranteed and depend partly on your
consistency in following the handover guidance after the program — see
clause 7. -
We may decline or end a program if a dog is unwell, unvaccinated,
or presents a safety risk to itself, other dogs, people or staff.
Bookings, deposits, cancellations and refunds are governed by our Refund
& Cancellation Policy.
