Terms & Conditions

Effective date: 4 August 2026

These Terms and Conditions (“Terms”) govern the supply of services by
Diverse Dogs Pty Ltd (ABN 29 656 858 990), trading as “Diverse
Dogs”
(“Diverse Dogs”, “we”, “us”, “our”), to you, the client
(“you”, “your”). By booking, paying for, taking part in or otherwise
using any of our services or activities — whether or not you have signed
a Client Agreement & Waiver — you agree to these Terms and
Conditions and to the relevant Client Agreement & Waiver for that
service. Please read them carefully and keep a copy.

Diverse Dogs Pty Ltd is based in Queensland, Australia. These
Terms should be read together with our Refund & Cancellation Policy
and the Client Agreement & Waiver for each service.

1. About us and these Terms

Diverse Dogs provides dog training, dog-care and related wellbeing
services across Brisbane, the Gold Coast, Tweed and online. We also
travel to other areas of Australia from time to time and deliver
services online Australia-wide. These Terms apply to all of our
services, together with any service-specific terms in the Schedules at
the end of this document, the separate Client Agreement & Waiver for
each service, and our Refund & Cancellation Policy. Together these
form the agreement between us. If there is any inconsistency, the signed
Client Agreement & Waiver and the relevant Schedule prevail for that
service.

We may update these Terms from time to time. The version in force
when you book applies to that booking. The current version is available
on request and at www.diversedogs.com.au.

These Terms cover the following services:

3. Bookings and acceptance

A booking is confirmed only once we have accepted it and any required
deposit or payment has been received. We may decline or cancel a booking
at our discretion, including where we consider a service is not suitable
or safe for a particular dog, handler or participant.

You accept these Terms by booking, paying for or taking part in any
of our services or activities, whether or not you have signed a Client
Agreement & Waiver. You must be at least 18 years of age to book or
participate. If you book for another person or organisation, you confirm
you are authorised to accept these Terms on their behalf.

4. Fees and payment

Fees are as quoted at the time of booking or in our current price
list. Unless stated otherwise, fees are in Australian dollars and
include GST where applicable.

We may accept payment through third-party “buy now, pay
later” providers
and other methods we make available. Where you
pay using a buy now, pay later provider, your finance arrangement is a
separate agreement between you and that provider, subject to the
provider’s own terms, eligibility criteria and fees. Diverse Dogs is not
a party to, and is not responsible for, that arrangement. You remain
responsible to us for the full price of the service unless and until it
is paid.

To keep everyone safe and give the service the best chance of

We will provide our services with due care and skill, using methods
we consider appropriate and humane, and within a reasonable time. Our
training is ethical and science-backed in how we communicate with and
teach dogs. While we prioritise reward-based training, in certain
circumstances we may recommend alternative, balanced methods suited to
the individual dog. The nature, order and pace of a service may be
adjusted to suit the dog, handler or participants.

7. Training and wellbeing outcomes are not
guaranteed

Dogs are living animals and their behaviour is influenced by many
factors outside our control, including genetics, health, environment,
age, prior experiences and the consistency of handling and practice
between sessions. Similarly, wellbeing activities affect people
differently. Except for the guarantees we cannot exclude under the
Australian Consumer Law, we do not and cannot guarantee any particular
result, timeframe, behavioural change, or that a dog or participant will
pass any assessment. Your commitment between sessions significantly
affects outcomes.

8. Assumption of risk and physical activity

You acknowledge that handling, moving with, training, exercising and
socialising a dog is a physical activity that carries inherent risks —
including being bitten, scratched, pulled, knocked over, tripped or
otherwise injured — and that some of our services also involve physical
exertion, movement and outdoor activity. You take part voluntarily and,
to the extent permitted by law, accept those inherent risks.

Before commencing each service you must complete and sign the
relevant Client Agreement & Waiver, which sets out
the service-specific terms, health and behaviour disclosures, and
assumption of risk. We may decline to provide a service until it is
signed.

Recreational services: some activities (including our Breaths
& Barks Retreats) are “recreational services” under the Australian
Consumer Law. Where they are, the relevant Client Agreement & Waiver
may lawfully exclude certain liability for death or personal injury
under section 139A of the Competition and Consumer Act 2010 (Cth).
Nothing in the waiver limits rights that cannot be excluded under the
Australian Consumer Law.

9. Health, safety and veterinary care

While your dog is in our care we will take reasonable care of its
safety and welfare. Dog training, handling, exercise and socialisation
carry inherent risks, including injury, illness, escape or, in rare
cases, death, which can occur despite reasonable care.

Whenever your dog is in our care without you present, you are
responsible for being contactable in case of emergency and for keeping
your contact and emergency details up to date — please tell us straight
away if your phone number or details change. If your dog becomes unwell
or injured, our trainers will give all due care and get your dog to a
vet as quickly as possible. However, many vets will only accept medical
decisions from the registered owner, so you acknowledge that making any
important medical decisions is your responsibility and that we cannot be
expected to make them on your behalf. All veterinary treatment, expenses
and bills are your responsibility.

10. Liability

Nothing in these Terms excludes, restricts or modifies any guarantee,
right or remedy you have under the Australian Consumer Law
(ACL)
or any other law that cannot lawfully be excluded. Our
services come with guarantees that cannot be excluded under the ACL.

To the maximum extent permitted by law, and except for those
non-excludable guarantees:

You are responsible for the behaviour of your dog at all times except
while it is directly in our care, including any injury or damage your
dog causes to people, animals or property.

11. Cancellations, rescheduling and refunds

Cancellations, rescheduling, no-shows and refunds are governed by our
Refund & Cancellation Policy, which forms part of
these Terms and includes rules specific to each service. Your rights
under the ACL always apply in addition to that policy.

12. Privacy

We collect personal information (such as your contact details and
information about your dog) to provide our services, and handle it in
accordance with the Privacy Act 1988 (Cth) and our Privacy Policy. We do
not sell your personal information. Payment information you provide to a
third-party payment or buy now, pay later provider is handled by that
provider under its own privacy policy.

13. Intellectual property

All training and course materials, manuals, handouts, videos and
assessment materials we provide (including for Dog Trainer Certification
and the retreats) remain our intellectual property or that of our
licensors, and are provided for your personal use only. You must not
copy, resell, redistribute, publish or commercially reuse them without
our written permission.

14. Media

We take photos and video during our services and use this content for
marketing and social media. By booking, taking part in or otherwise
using our services, you consent to us taking and using photos and video
that include you and/or your dog for these purposes. This consent
applies whether or not you have signed a Client Agreement &
Waiver.

15. Force majeure

We are not responsible for failing to provide a service where
prevented by events beyond our reasonable control (such as extreme
weather, natural disaster, illness, injury or government restrictions).
In those cases we will offer to reschedule or, where a service cannot be
provided, act in accordance with our Refund & Cancellation Policy
and the ACL.

16. Governing law

These Terms are governed by the laws of Queensland, Australia, and
you and we submit to the non-exclusive jurisdiction of its courts. If
any provision is unenforceable, the remaining provisions continue to
apply.
